Terms of Use
Last updated: September 3, 2025
These Terms of Use govern your access to and use of Digital Designer Designation (DDD), including the website at dddesignation.com, its online learning environment, courses, assessments, certificates, resources and related services.
Digital Designer Designation is operated by ALONSO.studio, based in Toronto, Ontario, Canada. In these Terms, “DDD,” “ALONSO.studio,” “we,” “us” and “our” refer to the operator of these services.
By creating an account, enrolling in a course, purchasing a service, or otherwise using DDD, you agree to these Terms.
If you do not agree with these Terms, please do not use the platform.
1. Using DDD
DDD provides professional learning, digital skills development, courseware, assessments, certificates of completion and related learning resources.
You may use DDD only in accordance with these Terms and applicable laws.
To create an account or purchase a service, you must be legally capable of entering into the applicable agreement. If you are using DDD on behalf of an organisation, you confirm that you have authority to act on its behalf where applicable.
You are responsible for:
- Providing accurate account information
- Maintaining the confidentiality of your login credentials
- Keeping your account information current
- Activities carried out through your account
- Informing us promptly if you believe your account has been compromised
Accounts are intended for individual use unless an organisational or multi-user arrangement has been expressly provided.
2. Learning Programs and Certificates
DDD courses and learning experiences are designed for professional and continuing skills development.
Unless a particular offering expressly states otherwise, a DDD certificate represents successful completion of the requirements established for that DDD course or program.
A DDD certificate is not a university degree, government licence, regulated professional designation, or accreditation by a third-party educational or professional body unless that status is explicitly identified for the particular program.
Requirements for employment, professional certification, licensing or recognition vary between organisations and jurisdictions. Learners are responsible for determining whether a particular course or certificate meets their own professional or employment requirements.
We do not guarantee employment, promotion, professional licensing, certification by another organisation, or any particular commercial outcome resulting from completion of a DDD program.
3. Access to Course Materials
When you enrol in a DDD offering, we grant you a limited, personal, non-exclusive and non-transferable right to access and use the associated learning materials for their intended educational purpose.
Unless expressly permitted in writing, you may not:
- Republish or redistribute course materials
- Sell, sublicense or commercially exploit course materials
- Share restricted course content or assessments publicly
- Provide another person with access through your account
- Reproduce substantial portions of a course for another training program
- Circumvent access, authentication or security controls
- Use course materials to create a competing course, product or service
- Use restricted DDD content to train or develop machine-learning or generative-AI models
Downloading or accessing material does not transfer ownership of that material to you.
4. Intellectual Property
Unless otherwise identified, the design, structure, courseware, written material, graphics, audiovisual material, assessments, learning activities, interfaces and other original content made available through DDD are owned by ALONSO.studio or used under licence.
These materials are protected by applicable Canadian and international intellectual-property laws.
Third-party names, trademarks, software, media and other materials remain the property of their respective owners.
Nothing in these Terms grants you ownership of DDD intellectual property or permission to use the ALONSO.studio or Digital Designer Designation names, trademarks, branding or course materials outside the permissions expressly provided.
5. Your Work and Content
Some DDD activities may allow you to submit assignments, projects, comments, files, responses or other material.
You retain ownership of original content you create.
By submitting material through DDD, you give us only the limited permission reasonably necessary to:
- Store and display it within the learning environment
- Evaluate or assess it
- Provide feedback
- Administer the course or program
- Maintain appropriate records of participation and completion
- Operate and secure the platform
This permission does not transfer ownership of your work to ALONSO.studio.
We will not publish or commercially exploit identifiable learner work outside the purposes for which it was submitted without obtaining appropriate permission, except where otherwise permitted or required by law.
6. Academic and Professional Integrity
Learners are expected to complete assessments honestly and in accordance with instructions provided within each course.
Academic or professional misconduct may include:
- Plagiarism
- Submitting another person’s work as your own
- Having another person complete an assessment for you
- Completing an assessment while impersonating another learner
- Sharing restricted assessment questions or answers
- Obtaining assessment materials through unauthorised means
- Manipulating completion or assessment records
- Using generative AI or other external tools where their use has expressly been prohibited for an assessment
The permitted use of AI and other tools may vary by course and activity. Where AI-assisted work is permitted, learners remain responsible for the accuracy, originality and integrity of what they submit.
Serious or repeated violations may result in assessment invalidation, withholding or revocation of a certificate, suspension of access, or termination of an account.
7. Acceptable Use
You may not use DDD or its associated systems to:
- Violate applicable law
- Infringe another person’s intellectual-property or privacy rights
- Harass, threaten or impersonate another person
- Distribute malware or malicious code
- Attempt unauthorised access to accounts, servers or systems
- Circumvent security or authentication measures
- Deliberately interfere with the operation of the platform
- Scrape, harvest or systematically extract restricted platform content without permission
- Use automated systems in a manner that places an unreasonable load on the platform
- Falsify learner identity, assessment results or credentials
- Misrepresent a DDD certificate or the scope of a DDD qualification
We may investigate suspected misuse and take reasonable action to protect learners, our systems and our intellectual property.
8. Third-Party Technology and Services
DDD may use or connect with third-party technology, including learning-management software, hosting providers, video platforms, payment processors, analytics services and other online tools.
Links to external websites or services do not constitute an endorsement of everything provided by those services.
Third-party platforms may operate under their own terms and privacy policies. We are not responsible for the operation of third-party services that are outside our reasonable control.
9. Payments
Some DDD courses, programs or services may require payment.
Prices and applicable taxes will be disclosed before purchase. Unless otherwise stated, prices displayed for Canadian customers are in Canadian dollars.
By purchasing a paid offering, you agree to provide valid payment information and authorise the applicable payment processor to process the transaction.
Where an organisation has entered into a separate contract with ALONSO.studio, that agreement may contain additional or different commercial terms. In the event of a conflict concerning that organisation’s contracted services, the signed agreement will govern.
10. Cancellations and Refunds
Refund and cancellation conditions applicable to a particular paid offering will be disclosed at the time of purchase where appropriate.
Unless different terms are expressly provided for an offering:
Individual course purchases
A request for cancellation and refund may be made within 14 days of purchase, provided that the learner has not substantially completed the course or been issued a certificate of completion.
Subscription services
Where a recurring subscription is offered, it may be cancelled before the next billing date to prevent renewal. Unless otherwise stated at purchase, cancellation takes effect at the end of the current paid billing period.
Organisational and consulting services
Custom development, consulting, platform implementation and organisational learning services are governed by the applicable proposal, statement of work or service agreement.
Statutory rights
Nothing in this policy limits any cancellation, refund or other consumer right that cannot legally be excluded under applicable law.
Where Ontario consumer-protection legislation gives a purchaser rights beyond these Terms, those statutory rights continue to apply.
11. Platform Availability and Changes
We aim to provide reliable access to DDD but do not guarantee that every part of the platform will always be available without interruption.
Maintenance, software updates, security requirements, third-party outages or circumstances outside our reasonable control may occasionally affect availability.
We may update, improve, replace or discontinue features where reasonably necessary.
Where a material change affects a paid course or service already purchased, we will make reasonable efforts to preserve access to the purchased learning experience or provide an appropriate alternative.
12. Security
We take reasonable measures to protect accounts, systems and information.
No online system can be guaranteed to be completely secure. You are responsible for protecting your own credentials and devices.
If you believe your account or personal information has been compromised in connection with DDD, contact us promptly at learn@alonso.studio.
13. Privacy
Personal information collected through DDD is handled in accordance with our Privacy Policy and applicable privacy law.
We collect and use information only for legitimate purposes associated with operating the learning platform, delivering services, maintaining records, communicating with users, improving our services and meeting legal obligations.
Where third-party service providers process information on our behalf, their involvement may also be governed by their own privacy and security practices.
14. Feedback
We welcome feedback about DDD.
If you provide ideas, comments or suggestions about improving the platform or our services, you permit us to consider and use that feedback without creating an obligation to compensate you.
This provision does not transfer ownership of course assignments, creative work or other learner content submitted for educational purposes.
15. Disclaimer
DDD is intended to provide educational and professional-development resources.
While we make reasonable efforts to ensure that our material is accurate and useful, information and professional practices can change over time.
To the extent permitted by applicable law, DDD and its content are provided without guarantees that participation will produce a specific professional, financial, employment, certification or business outcome.
Nothing on DDD should be interpreted as legal, financial, medical or other regulated professional advice unless expressly identified as such and provided by a suitably qualified professional.
Nothing in these Terms excludes warranties, guarantees or other rights that cannot legally be excluded.
16. Limitation of Liability
To the extent permitted by applicable law, ALONSO.studio will not be liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, DDD or its learning materials.
Where liability cannot legally be excluded but may be limited, our aggregate liability relating to a paid service will not exceed the amount paid by the claimant to us for that service during the twelve months immediately preceding the event giving rise to the claim.
These limitations do not apply where liability cannot legally be excluded or limited.
17. Suspension or Termination
We may suspend or terminate access where reasonably necessary because of:
- A serious or repeated breach of these Terms
- Fraud or misrepresentation
- Academic misconduct
- Unauthorised use of the platform
- Security threats
- Non-payment of applicable fees
- Conduct that materially interferes with our services or the rights of others
Where reasonable in the circumstances, we will provide notice of the issue and an opportunity to resolve it.
Termination does not transfer or eliminate intellectual-property rights or payment obligations that arose before termination.
18. Copyright or Intellectual-Property Concerns
If you believe material available through DDD infringes copyright, trademark or another intellectual-property right, contact:
Please identify:
- The work or right you believe is affected
- The material on DDD that concerns you
- Where the material appears
- Your contact information
- The basis for your claim
We will review legitimate notices and take appropriate action where necessary.
19. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
Subject to any mandatory rights available to consumers under applicable law, disputes relating to these Terms or DDD will be subject to the jurisdiction of the courts of Ontario.
Nothing in these Terms deprives a consumer of protections or remedies that cannot legally be waived or restricted.
20. Changes to These Terms
We may update these Terms when our services, technology, business practices or legal obligations change.
The current version and its effective date will be published on this page.
Material changes affecting existing users or paid services will be communicated where reasonably required.
Continued use of DDD after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
21. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
22. Entire Agreement
These Terms, together with any policies or purchase terms expressly incorporated into them, govern general use of DDD.
For organisational clients, consulting engagements or custom development projects, a separate signed agreement, proposal or statement of work may govern those services and will take precedence where its terms conflict with these general Terms.
